General Terms and Conditions – SimTopia

0.0 – Definitions

0.1 SimTopia: the trade name of the online platform accessible at https://simtopia.nl, owned and operated by SimTopia (hereinafter: “SimTopia”, “we”, “us” or “our”).

0.2 User: any natural person or legal entity using SimTopia’s services, including but not limited to the website, webshop, community, downloads, forums, clubs or gallery.

0.3 Products: digital products, such as software, add-ons, downloads or licence keys, offered through the SimTopia webshop, whether free of charge or paid.

0.4 Services: all online features and services offered by SimTopia, including forums, clubs, digital downloads, accounts and the webshop.

0.5 Agreement: any agreement between SimTopia and a user concerning the use of the website or services, or the purchase of products.

0.6 Uploader: a user who adds content, files, images or other materials to SimTopia or submits them to SimTopia for publication.

0.7 Download Content: any digital file that an uploader publishes as a download through SimTopia or submits to SimTopia for publication, including associated descriptions, images, documentation and updates.

1.0 – Applicability

1.1 These General Terms and Conditions apply to every use of the website, community, downloads and webshop, and to all offers, orders and agreements concluded through SimTopia.

1.2 By using the website, placing an order or adding content, the user agrees to these General Terms and Conditions.

1.3 Any deviation from these General Terms and Conditions is valid only if expressly confirmed in writing by SimTopia.

2.0 – User Accounts and Conduct

2.1 A user account may be required to participate in the community or download content.

2.2 The user is responsible for ensuring that their information is accurate and for keeping their login credentials confidential.

2.3 Accounts are strictly personal and may not be shared with third parties.

2.4 Posting offensive, discriminatory or illegal material, or copyrighted material for which the user does not have the required permission or usage rights, is prohibited.

2.5 SimTopia reserves the right to suspend accounts temporarily or permanently in the event of a breach of these General Terms and Conditions or misuse.

3.0 – Intellectual Property

3.1 All content on SimTopia – including texts, images, software, product descriptions, logos, source code and design – is owned by SimTopia or its licensors.

3.2 Content may not be copied, distributed, modified or used commercially without SimTopia’s written permission, unless such use is permitted by law.

3.3 Rights to content provided by third parties, including community uploads and ChrisTrains and wilburgraphics products, remain vested in the original creator or other rights holder.

3.4 The licence described in Article 5.7 applies to Download Content. Article 13 also applies to images.

4.0 – Digital Products and Delivery

4.1 Products in the SimTopia webshop are supplied exclusively in digital form, for example through download links or licence keys.

4.2 Delivery generally takes place immediately after successful payment, unless a different delivery period is stated in the offer.

4.3 If the supply of digital content begins before the statutory withdrawal period has expired, SimTopia will request the consumer’s prior express consent to immediate delivery.

4.4 The consumer loses the statutory right of withdrawal for digital content not supplied on a tangible medium only if performance has begun with the consumer’s prior express consent and the consumer has acknowledged that the right of withdrawal will thereby be lost. SimTopia will confirm this acknowledgement in accordance with the applicable statutory requirements.

4.5 The loss of the right of withdrawal does not affect the user’s statutory rights if a product has not been delivered, is defective or does not conform to the Agreement.

5.0 – Free Downloads and Community Content

5.1 SimTopia also offers free downloads, including community add-ons, vehicles, routes and other files shared by members.

5.2 Free downloads are supplied in their current condition (“as is”), without any guarantee regarding functionality, support or updates, to the extent permitted by law.

5.3 SimTopia may perform a general security check on uploads but cannot guarantee that every free download is free from errors, harmful software or infringements of third-party rights. Users remain responsible for taking appropriate security measures.

5.4 Users may not republish, sell or otherwise make available free downloads created by others without permission from the creator or other rights holder.

5.5 To the extent permitted by law, SimTopia is not liable for damage or loss resulting from the use of free downloads or community content.

5.6 The uploader represents that they are authorised to publish the Download Content and that the content does not infringe copyrights, trademarks, privacy rights or other third-party rights and is not contrary to the law.

5.7 By adding Download Content to SimTopia or submitting it for publication, the uploader grants SimTopia a non-exclusive, worldwide and royalty-free licence for an indefinite period to host, store, technically process, copy, distribute and make the Download Content publicly accessible through the platform. This licence also includes creating backups and making technically necessary modifications for security, compatibility and availability purposes. Copyright remains vested in the uploader or other rights holder.

5.8 By adding Download Content, the uploader agrees that the content will, in principle, remain available as a download on SimTopia for an indefinite period. If the uploader wishes to have the Download Content taken offline, they must submit a request to downloads@simtopia.nl. The request must include at least the title or URL of the download, the account name used and a brief explanation. SimTopia may request additional information to verify the identity or rights of the requester and will process the request within a reasonable period.

5.9 Article 5.8 does not guarantee that a download or the platform will be technically available without interruption. SimTopia may also take Download Content temporarily or permanently offline without receiving a request if SimTopia considers this necessary because of a legal obligation, a report or suspected infringement of third-party rights, security risks, technical reasons, a breach of these General Terms and Conditions or the discontinuation of a service.

6.0 – Payment

6.1 Payments must be made using one of the payment methods offered on the website.

6.2 An order will not be processed until payment has been successfully received.

6.3 In the event of a chargeback, failed payment or fraud, SimTopia reserves the right to block delivery or restrict the account, subject to applicable law.

7.0 – Refund Policy

7.1 Once digital content has been supplied with the required consent and the statutory right of withdrawal has validly expired, the purchase cannot be cancelled or refunded solely because the user has changed their mind.

7.2 If a product has not been supplied due to an error by SimTopia, does not conform to the Agreement or is defective, the user is entitled to the remedies provided by law. Depending on the circumstances, these may include repair, replacement, a price reduction, termination or a refund.

7.3 In the event of technical problems, the user may request assistance through the helpdesk. The provision of support does not limit the user’s statutory rights.

8.0 – Specific Terms for ChrisTrains Products

8.1 – Nature of the Products
ChrisTrains products offered through SimTopia are digital software products, such as add-ons, vehicles and expansions, and are subject to the copyrights and licence terms of ChrisTrains.

8.2 – Applicable Terms
In addition to these General Terms and Conditions, the official ChrisTrains terms apply to all ChrisTrains products sold through SimTopia. The following documents will be brought to the user’s attention when making a purchase:

Mandatory consumer law will prevail in the event of any conflict.

8.3 – Right of Withdrawal
Article 4.4 applies to the right of withdrawal for ChrisTrains products. The right of withdrawal does not expire solely because payment has been made. It expires only when the statutory requirements for the immediate supply of digital content have been satisfied.

8.4 – Support and Updates
SimTopia provides support for ChrisTrains products within the scope of the original purchase. If a product is subsequently released as a separate new product or paid upgrade, an additional purchase may be required. This does not limit the user’s statutory rights in the event of non-conformity.

9.0 – Liability

9.1 To the extent permitted by law, SimTopia is not liable for damage caused by incorrect installation, incompatibility with unsupported external software or use contrary to the instructions supplied with the product.

9.2 SimTopia does not guarantee that the website, downloads or community will be available without errors or interruptions at all times.

9.3 SimTopia is not responsible for content, links or uploads posted by users, but may take action against such material once it becomes aware of unlawful content or if the content violates these General Terms and Conditions.

9.4 Nothing in these General Terms and Conditions excludes liability to the extent that such exclusion is prohibited by mandatory law.

10.0 – Privacy

10.1 SimTopia processes personal data in accordance with the General Data Protection Regulation (GDPR).

11.0 – Misuse and Enforcement

11.1 In the event of suspected misuse, fraud, improper use of discount codes, copyright infringement or piracy, SimTopia reserves the right to take appropriate measures, including refusing a discount, suspending an account, blocking downloads or notifying rights holders.

11.2 In the event of serious or repeated violations, the account may be permanently deleted. Deletion of an account does not limit any mandatory statutory right to a refund.

12.0 – Governing Law and Disputes

12.1 All agreements between SimTopia and the user are governed by Dutch law. Consumers retain the protection afforded by the mandatory provisions of the law that would apply in the absence of this choice of law.

12.2 Disputes will be submitted to the court having jurisdiction under applicable law. For consumers, the court having jurisdiction will be determined in accordance with the applicable statutory rules.

13.0 – Use of Images

13.1 – Permission
By participating in Screenshot of the Month, posting images in the gallery or uploading images to downloads, forum topics or other parts of SimTopia, the user grants SimTopia permission to use those images in accordance with this Article. The user represents that they are authorised to grant this permission.

13.2 – Use by SimTopia
SimTopia may use the images for promotional and communications purposes relating to the platform, including on the website, social media, in newsletters and in banners. Separate permission is not required for each individual use.

13.3 – Ending Future Use
A user wishing to end the future use of an image may submit a request to info@simtopia.nl. SimTopia will process the request within a reasonable period. Materials that have already been lawfully produced or published do not have to be recalled unless required by law.

13.4 – Copyright and Attribution
Copyright remains vested in the user or other rights holder. SimTopia will credit the user where reasonably practicable. Attribution is not required where it is not reasonably practicable, such as in a website header.

14.0 – Merchandise Shipping Costs

14.1 When purchasing merchandise with an order value of less than €25, the separate shipping-cost package must be added to the order.

14.2 If an order is placed without the required shipping-cost package, SimTopia reserves the right to suspend the order. The customer will then have five days to purchase the shipping-cost package.

14.3 If the shipping-cost package is not purchased within this period, the order will be cancelled and the amount already paid will be refunded through the original payment method no later than fourteen days after cancellation.

14.4 For merchandise orders with an order value of €25 or more, the separate shipping-cost package is not required.

14.5 For the purposes of this Article, the order value consists exclusively of the total value of the merchandise purchased. Digital products and services are not included in this calculation.

15.0 – Final Provisions

15.1 SimTopia may amend these General Terms and Conditions. Amendments will not apply retroactively to the user’s detriment. Users will be appropriately informed of material amendments before they take effect.

15.3 If any provision is declared invalid or unenforceable, the remaining provisions will remain in full force.
