Terms and Conditions – SimTopia

0.0 – Definitions
0.1 SimTopia: the trade name of the online platform accessible via https://simtopia.nl, owned and operated by SimTopia (hereinafter: “SimTopia”, “we”, “us”, or “our”).
0.2 User: any natural or legal person who uses the services of SimTopia, including – but not limited to – the website, webshop, community, downloads, forums, clubs, or gallery.
0.3 Products: digital products (such as software, add-ons, downloads, or license keys) offered via the SimTopia webshop, both free and paid.
0.4 Services: all online features or services provided by SimTopia, including forums, clubs, digital downloads, accounts, and the webshop.
0.5 Agreement: any agreement between SimTopia and a user regarding the use of the website, services, or purchase of products.
1.0 – Applicability
1.1 These terms and conditions apply to every use of the website, community, downloads, webshop, and to all offers, orders, and agreements concluded through SimTopia.
1.2 By using the website or placing an order, the user agrees to these terms and conditions.
1.3 Deviations from these terms are only valid if expressly and in writing confirmed by SimTopia.
2.0 – User Account and Conduct
2.1 Participation in the community or downloading content requires a user account.
2.2 The user is responsible for the accuracy of their information and for keeping login credentials confidential.
2.3 Accounts are strictly personal and may not be shared with third parties.
2.4 Posting offensive, discriminatory, illegal, or copyrighted material on the platform is prohibited.
2.5 SimTopia reserves the right to temporarily or permanently suspend accounts in case of violations or abuse.
3.0 – Intellectual Property
3.1 All content on SimTopia – including text, images, software, product descriptions, logos, source code, and design – is owned by SimTopia or its licensors.
3.2 It is prohibited to copy, distribute, modify, or commercially use any content without written permission from SimTopia.
3.3 Rights to third-party content (such as community uploads or ChrisTrains products) remain with the original creator.
3.4 By uploading content, the user grants SimTopia a non-exclusive, worldwide license to display that content within the platform.
4.0 – Digital Products and Delivery
4.1 Products in the SimTopia webshop are delivered digitally only, via download links or license keys.
4.2 Delivery takes place immediately after successful payment.
4.3 The user acknowledges that the delivery of digital content begins immediately upon payment.
4.4 By paying, the user explicitly agrees to immediate delivery and waives their statutory right of withdrawal (Article 16d of the Consumer Rights Directive).
4.5 After payment, cancellation or refunds are no longer possible.
5.0 – Free Downloads and Community Content
5.1 SimTopia also offers free downloads, including community add-ons, vehicles, routes, or other files shared by members.
5.2 Free downloads are provided “as is,” without any guarantee of functionality, support, or updates.
5.3 SimTopia performs basic safety checks on uploads but cannot guarantee that all free downloads are free of errors, viruses, or copyright violations.
5.4 Users may not republish, sell, or redistribute free downloads from others without the creator’s written permission.
5.5 SimTopia is not liable for any damage or loss resulting from the use of free downloads or community content.
6.0 – Payment
6.1 Payments must be made using the payment methods offered on the website.
6.2 Orders are processed only after successful payment.
6.3 In case of chargebacks, failed payments, or fraud, SimTopia reserves the right to block delivery or restrict the account.
7.0 – Refund Policy
7.1 For all digital products, refunds are not possible once payment has been made, as delivery starts immediately.
7.2 Refunds are only possible if delivery has not occurred due to an error on the part of SimTopia and the product has not been made available.
7.3 In case of technical issues, SimTopia provides support through its helpdesk, but this does not entitle the user to a refund.
8.0 – Specific Terms for ChrisTrains Products
8.1 – Nature of the Products
ChrisTrains products offered through SimTopia are digital software products (such as add-ons, vehicles, and expansions) and are subject to ChrisTrains’ copyright and license terms.
8.2 – Applicable Conditions
For all ChrisTrains products sold through SimTopia, both these terms and the official ChrisTrains terms apply.

8.3 – Right of Withdrawal
Since ChrisTrains products are delivered digitally and become immediately available after payment, the right of withdrawal expires upon purchase.
By purchasing, the user explicitly agrees to immediate delivery and acknowledges that the purchase is final.
8.4 – Support and Updates
SimTopia provides support for ChrisTrains products only within the scope of the original purchase.
If a product is later updated or re-released, an additional purchase may be required.
9.0 – Liability
9.1 SimTopia is not liable for damage resulting from the use of digital products, incorrect installation, incompatibility, or errors in third-party software.
9.2 SimTopia does not guarantee that the website, downloads, or community will be error-free or continuously available.
9.3 SimTopia is not responsible for damage resulting from user-generated content, links, or uploads.
10.0 – Privacy
10.1 SimTopia processes personal data in accordance with the General Data Protection Regulation (GDPR).

11.0 – Misuse and Enforcement
11.1 In cases of suspected abuse, fraud, copyright infringement, or piracy, SimTopia reserves the right to take measures, including account suspension, blocking of downloads, or reporting to rights holders.
11.2 In the event of serious or repeated violations, the account may be permanently deleted without refund.
12.0 – Applicable Law and Disputes
12.1 All agreements between SimTopia and the user are governed exclusively by Dutch law.
12.2 Disputes will be submitted solely to the competent court in the district where SimTopia is established.
13. Use of Images
13.1 Permission
By participating in the Screenshot of the Month, posting images in the Gallery, or uploading photos to downloads, forum topics, or other parts of SimTopia, the user automatically grants SimTopia permission to use these images.
13.2 Use by SimTopia
SimTopia may use the images for promotional and communication purposes. This includes, but is not limited to, the website, social media, newsletters, and banners. No additional consent is required for such use.
13.3 Withdrawing Permission
Users who do not wish to grant permission can submit a request via info@simtopia.nl. Upon receipt, SimTopia will cease using the relevant images.
13.4 Copyright and Attribution
Copyright remains with the user. SimTopia will credit the user where practically possible. Attribution is not required in cases where it is not feasible, such as the website header.
14.0 Misuse of Gimme Discount
14.1 Misuse of the Gimme discount is not permitted. Misuse includes, but is not limited to, the improper use of discount codes, vouchers, or promotional offers to which the customer is not entitled.
14.2 If misuse is identified, we reserve the right to fully recover the discount amount obtained without entitlement, increased by 21% VAT.
14.3 In the event of misuse, we may refuse further discounts and block the use of discount vouchers on the customer’s account.
14.4 If repayment is not made, we reserve the right to transfer the claim to a collection agency. Any additional (collection) costs incurred shall be borne by the customer.
15.0 – Final Provisions
15.1 SimTopia reserves the right to amend these terms and conditions at any time.
15.2 The most recent version is always available at https://simtopia.nl/algemene-voorwaarden.
15.3 If any provision is declared invalid, the remaining provisions shall remain fully in effect.
